In short: Atlas Crew is a free app for yacht and gulet crew and the charter companies that hire them. Sail Atlas only provides the technology: we are not your employer or agent, we do not verify certificates or companies, and any work agreement or payment is between you and the charter company. You keep ownership of what you upload, decide what is public and can delete your account at any time.

1. About these terms

These Terms of Use (“Terms”) are an agreement between you and HeyAtlas.ai LLC, a New Jersey (USA) limited liability company doing business as Sail Atlas (“Sail Atlas”, “we”, “us”), 2037 Lemoine Ave, Suite 330, Fort Lee, NJ 07024, United States.

They apply to the Atlas Crew mobile app (also called the “Crew App”) and its related web pages: your public profile page (the “showcase”), the review link page, and the offer and crew-selection pages that charter companies send to their customers (together, the “App”). You accept these Terms when you create an account.

The Crew App Privacy Notice explains how we process personal data. The Explicit Consent text applies only if you choose to share information that may count as health data.

2. Who can use the App

  • You must be at least 18 years old.
  • A crew account is for an individual who works, or wants to work, as yacht, gulet or boat crew. One person, one account, and the profile must be about you.
  • A company account is for a charter company or other business that hires crew, opened by a person authorised to act for it (see section 11).
  • Your information must be true and kept up to date.

3. Your account and security

Keep your password confidential and do not share your account. Tell us at once at info@sailatlas.app if you think someone else has used it.

Your calendar subscription (ICS) link works like a password: anyone who has it can see your calendar, including your notes. Share it only with calendar apps you trust. Turning the subscription off in the App stops every existing link.

4. Fees

The App is free for crew: creating an account, publishing your profile, being listed in the crew pool, receiving requests, applying to job listings and using the calendar cost nothing. Company accounts are currently free as well. There are no in-app purchases or subscriptions. If we ever introduce paid features, we will tell you in advance, show the price before you buy and never charge you without your express agreement.

The App does not handle payments. Pay shown in listings and requests, and the earnings figures in your account, are information entered by users. Any payment is made outside the App, directly between you and the charter company.

5. Our role: a technology provider

Sail Atlas provides the technology only:

  • We are not a party to any contract between crew and charter companies (employment, freelance engagement, booking or offer) or to payments between them.
  • We are not an employer, manning agency, recruiter or agent of either side, and we do not negotiate or sign contracts for anyone.
  • We do not vet, employ or guarantee crew or companies. We do not check identity, certificates, experience, reviews or work permits, or a company’s licences, insurance or ability to pay.
  • A “Verified company” badge only means that we carried out a basic check of that company account and lifted its daily request limit. It is not an endorsement or a guarantee.

Check the other party yourself before you agree to work or hire. Disputes about work, pay, cancellations, safety or conduct are between you and the other party.

6. Your profile, showcase and the crew pool

What is public. Anyone with the link can view your showcase without signing in. It can be embedded in other websites, appears in link previews (name, role and short intro) and may be indexed by search engines. Your name, roles and profile photo are always shown; other sections are shown unless you hide them (see section 6 of the Privacy Notice).

Crew pool. While pool visibility is on, charter companies using Sail Atlas can see your directory card and profile. While “findable by other companies” is on, a company using the Atlas Dashboard can copy your details into its own crew records, which then become that company’s record. Turning these off stops future display but does not undo copies already made.

Accuracy. Your profile must be true and about you. Do not overstate your experience or use another person’s photo. Keep your availability and work rules up to date.

Certificates. Upload only genuine certificates issued to you, with their real dates. Never upload fake, altered or borrowed certificates. Sail Atlas does not verify certificates, and you remain responsible for holding the certificates a job requires. By default, certificate details including numbers and document images are visible on your showcase; hide them in the showcase settings if you prefer.

Health information. Your smoking status and medical certificates may count as health data. We process them only with your explicit consent.

Photos. Upload only photos you have the right to use. Do not post photos of identifiable guests, other crew or children without their (or their parents’) permission.

7. Requests and the contact details you receive

Charter companies and visitors to your showcase can send you availability requests, which you may accept or decline. An accepted request is not a contract with Sail Atlas; agree the role, dates, pay and conditions directly with the requester, in writing where possible. If you delete a block reserved for a company, the dates show as free again, so tell the company first.

When someone sends you a request, the App shows you their name, email, phone number, company, route and note. Use this information only to answer that request and arrange the charter work concerned. Do not use it for marketing, share or sell it, or keep it longer than needed. Charter companies must treat crew contact details the same way.

8. Job listings and applications

For crew. When you apply, the company sees your contact details, profile summary and message, whatever your showcase settings. Listing details (pay, dates, route, boat, requirements) come from the company and are not checked by us. Never pay anyone to get a job through the App, and report listings that ask for fees or deposits.

For companies. Listings must be real, open positions under your own name, described accurately (role, dates, pay, base, conditions) and closed once filled. Comply with the law that applies to the work, including employment, equal treatment, work permit and maritime rules. Do not set unlawfully discriminatory requirements, charge crew any fee, ask for passport, ID or bank details before you really need them, or post illegal, unsafe or non-crew work. Use applicants’ information only to assess the application and arrange the work.

9. Reviews

Your review link. You can share a personal review link with clients and companies you have worked with. Reviews sent through it appear on your profile and showcase only after you approve them, and you can remove them later. Turning the link off stops it at once; turning it on again creates a new link. Because you choose which of these reviews to show, the showcase states that they are approved by you and not verified by Sail Atlas.

Booking reviews. Guests and charter companies may rate the crew of a booking through Sail Atlas products; these reviews can also appear on your profile.

Rules. A review must reflect a genuine experience. Do not review yourself, buy or swap reviews, reward only positive reviews, pretend to be someone else, or post insults, threats, other people’s personal data or false statements of fact.

Moderation. We do not check every review before it is published. When we become aware of a review that is unlawful, abusive or fake, or that breaks these Terms, we may remove or hide it and turn off the review link concerned. Report reviews to info@sailatlas.app.

10. Calendar, connected services and messaging

  • Subscribed calendar apps refresh on their own schedule, and we do not guarantee when updates or reminders arrive. Charters a company confirms for you may be added automatically; check them.
  • If you connect Google Calendar, you allow us to create and update events in it. Google’s terms apply to your Google account. You can disconnect at any time.
  • In-app messaging is for communication about charter work. Be respectful, and do not send spam, advertising, malware or unlawful content. Messages you sent stay in the other party’s history after you delete your account. We do not read your messages, except where needed to investigate a report, protect security or comply with the law.

11. Company accounts

Business use. By registering a company account, you confirm that you act for a business, not as a consumer, and may bind it.

Company accounts can search the crew pool, send requests (5 a day until verified), publish job listings, keep boat records and contract templates, and send offers and crew-selection links to customers.

Responsibilities. The business is responsible for its listings, offers, contract templates and crew-selection links; for its contracts and payments with customers and crew; for complying with consumer and employment law; and for handling personal data it obtains through the App lawfully, as a separate controller. It must not copy or export the crew pool, or contact crew for anything other than genuine work. The business will compensate Sail Atlas for third-party claims arising from its listings, offers, contracts or breach of the law, to the extent the law allows.

Which terms apply. These Terms apply to company accounts, except that the consumer rules in section 18 do not apply. If the business also has an Atlas Platform subscription, the Atlas Platform Subscription Agreement governs that subscription and prevails for Platform services.

12. Acceptable use

You must not:

  • break the law or other people’s rights, including intellectual property, privacy and image rights;
  • create a false profile, impersonate anyone, or upload fake certificates, experience or reviews;
  • harass, threaten or discriminate against anyone, or post hateful, sexual or violent content;
  • send spam, or recruit for anything other than genuine crew work;
  • collect, scrape or export profiles, contact details or other data in bulk beyond the features the App offers;
  • upload malware, bypass our security, rate limits, request limits or access controls, or reverse engineer the App except where the law allows;
  • use the App to arrange unlawful or unsafe work, including work without the required permits or certificates.

13. Your content and our App

“Your content” is what you add to the App: profile information, photos, certificates, calendar entries and notes, messages, applications, listings and reviews you write. You keep ownership of it and confirm that you have the rights needed to add it.

You give Sail Atlas a non-exclusive, worldwide, royalty-free licence to host, store, copy, process, technically adapt (for example resize, compress or automatically translate), display and transmit your content only as needed to operate and provide the App. This includes displaying your showcase publicly, allowing it to be embedded in other websites and shown in link previews and search results, and showing your profile in the crew pool, to charter companies and to their guests, each according to your visibility settings.

The licence ends when you remove the content or delete your account, except for backups until deleted under our retention periods, content already shared with others (messages, applications, details a company has copied) and content we must keep by law. We do not sell your content or use it for advertising.

The App, its software and design, and the names and logos Sail Atlas, Atlas and Atlas Crew belong to us or our licensors. We give you a personal, non-exclusive, non-transferable and revocable licence to use the App for its intended purpose under these Terms.

14. Third-party services, content and links

The App works with services of other companies, such as Apple and Google, and may link to other websites. We do not control them; their own terms apply. Content from other users, such as listings, offers and reviews, is the responsibility of the user who created it.

15. Availability and changes to the App

We cannot promise that the App will always be available or free of errors. We may change, add or remove features for valid reasons, such as security, legal requirements, technical changes or product improvement. If a change materially and negatively affects you, we will tell you at least 30 days in advance where reasonably possible, and you can delete your account at no cost. If we stop offering the App, we will give you at least 30 days’ notice.

16. Ending your use

By you. You can stop at any time and delete your account in the App (Settings → Delete account) or as described on the Delete your account page. Your showcase, pool listing and review link go offline immediately, and your account data is deleted or anonymised within 30 days, except as described in the Privacy Notice.

By us. We may suspend or close your account, remove content or limit features (such as requests, the review link or pool visibility) if you break these Terms or the law, if your account puts others or us at risk (for example fraud or a security threat), or if a law or authority requires it. Where reasonable, we will tell you in advance, give our reasons and let you respond or fix the problem. In serious cases (fake certificates, fraud, threats, illegal content) we may act at once and tell you afterwards. You can ask us to review a decision at info@sailatlas.app.

Sections 13, 17, 18 and 21 survive the end of these Terms.

17. Disclaimers and liability

To the extent the law allows, the App is provided “as is”. We do not promise that you will find work or crew, that information from other users (certificates, reviews, listings, pay, earnings) is accurate, or that they will keep their commitments. Earnings figures are not payroll or tax records.

Nothing in these Terms excludes or limits our liability for intent or gross negligence, death or personal injury caused by our negligence, fraud, liability under mandatory product liability law, or any other liability that cannot be excluded by law, including the mandatory rights of consumers. Subject to that, and to the extent the law allows:

  • we are not liable for the acts or omissions of other users, for example a company or crew member failing to honour an agreement, pay or turn up;
  • we are not liable for indirect loss, lost profits, lost earnings or lost opportunities;
  • because the App is free, our total liability for all other claims in any 12-month period is limited to USD 100 (or its equivalent).

If you are a consumer in the EU or the UK, we are responsible for foreseeable loss caused by our breach of these Terms or our failure to use reasonable care and skill.

18. Consumer rights, governing law and disputes

Consumers. Many crew members use the App for their work and are then usually not consumers. If the law of your country of residence treats you as a consumer, its mandatory consumer protections apply and nothing in these Terms limits them. In Türkiye, consumers may apply to the Consumer Arbitration Committees (Tüketici Hakem Heyetleri) within the limits set each year, or to the Consumer Courts (Tüketici Mahkemeleri), under Law No. 6502; mediation may be required before court for some claims. In the EU/EEA, you keep the protection of the mandatory law of your member state.

Governing law. These Terms are governed by the laws of the State of New Jersey, USA, without regard to its conflict-of-law rules. For consumers, this choice does not remove the protection of the mandatory law of their country of residence.

Courts. Consumers may bring a claim in the courts of their place of residence, and we will bring claims against consumers only there. Business users (including company accounts) agree to the state and federal courts in Bergen County, New Jersey, unless mandatory law provides otherwise.

There is no mandatory arbitration and no class-action waiver. Before going to court, please write to info@sailatlas.app; we aim to resolve complaints within 30 days. This does not limit your right to go to a court or authority.

19. Changes to these Terms

We will tell you about material changes in the App or by email at least 30 days before they take effect. Changes required by law or for security, or that only benefit you, may take effect sooner. If you do not agree, you can delete your account before the change takes effect. If you keep using the App after that date, the new Terms apply, unless the law requires your express consent, in which case we will ask for it.

20. Privacy

The Crew App Privacy Notice explains how we process your personal data. Handle other people’s data you see in the App lawfully and only for the purposes allowed in these Terms.

21. General

  • These Terms are the whole agreement about the App. If a provision is invalid, the rest stays in force.
  • We may transfer this agreement in a merger or reorganisation if your rights are not reduced. You may not transfer your account.
  • These Terms are available in English and Turkish. If the versions differ, the Turkish version applies to users in Türkiye and the English version to everyone else.
  • If you downloaded the App from the Apple App Store or Google Play, these Terms are between you and Sail Atlas, not Apple or Google, which are not responsible for the App or its support. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.
