In short: Atlas Charter is a free app that lets you follow your charter booking, fill in the passenger list, prepare for check-in and message your charter company. Sail Atlas only provides the app. Your charter contract, its price and payments, and the services on board are between you and the charter company you booked with. Please keep the passenger list accurate and add other people only if you are allowed to. You can delete your account at any time, and as a consumer you keep the mandatory protections of your country.

1. About these terms

These Terms of Use (“Terms”) are an agreement between you and HeyAtlas.ai LLC, a New Jersey (USA) limited liability company doing business as Sail Atlas (“Sail Atlas”, “we”, “us”), 2037 Lemoine Ave, Suite 330, Fort Lee, NJ 07024, United States.

They apply to the Atlas Charter app (also called the “Customer App”) on mobile and on the web (the “App”). You accept these Terms when you create an account or sign in as a guest with your booking details.

The Customer App Privacy Notice explains how personal data is processed in the App. Your charter company’s own terms and privacy notice also apply to your booking.

2. Who can use the App

  • You must be at least 18 years old to create an account or sign in.
  • The App is for guests of charter companies that use Sail Atlas. To see a booking, you need booking details from your charter company.
  • You may add other people, such as the people you travel with, to a passenger list only if you are authorised to do so and have told them about it (see section 6).

3. Signing in and your account

Account. You can create an account with your name, email address and a password, then link one or more bookings to it with a booking number or QR code. You can link bookings from different charter companies; each company sees only its own bookings. You can also remove a booking from your account without deleting the booking itself.

Guest sign-in. You can also sign in without an account, using your booking number and last name. Anyone who knows these details can open the booking in the same way, so keep your booking number confidential and tell your charter company if you think someone else has used it.

Security. Keep your password confidential and do not share your account. Tell us at once at info@sailatlas.app if you think someone else has used it.

4. Fees and payments

The App is free. There are no in-app purchases or subscriptions, and the App does not take payments. If we ever introduce paid features, we will tell you in advance, show the price before you buy and never charge you without your express agreement.

Prices shown in the App, for example for extras or provisioning, are set by your charter company. Payment for your charter and for anything you order is arranged directly with the charter company, outside the App. Any APA (advance provisioning allowance) statement shown in the App is kept by the charter company and its crew; ask them about any figure in it.

5. Sail Atlas and your charter company

The App is provided by Sail Atlas as a technology service for charter companies and their guests. Please note:

  • The charter company is responsible for your booking. Your charter contract, its price, payment, deposit, cancellation and refund terms, the boat, the crew and every service on board are a matter between you and the charter company. Sail Atlas is not a party to the charter contract or to any payment between you and the company.
  • Booking data belongs to the charter company. For booking details, passenger lists, documents, check-in records, orders and messages, the charter company is the data controller and Sail Atlas processes that data on its behalf (see the Privacy Notice).
  • Information comes from the charter company. Booking, boat, crew, document and guide information is provided by the charter company. We do not check it and cannot guarantee that it is complete or up to date.
  • We do not vet charter companies or crew. We do not check their licences, insurance, boats or qualifications, and we do not guarantee their performance.

Complaints about your charter, the boat, the crew or payments should be sent to the charter company. Disputes about them are between you and the company. If you cannot reach the company, write to us and we will try to help you contact it.

6. Passenger list and documents

Many charter companies must report a passenger and crew list to port, coast guard or immigration authorities. The App helps you fill it in. When you add information to the passenger list:

  • Be accurate. Enter names, dates of birth, nationality and ID or passport details exactly as they appear in the documents, and update them if something changes.
  • Add others only with authority. Add the people you travel with only if they have asked or allowed you to, and after telling them about the Privacy Notice and the charter company’s notice. You may add a person under 18 only as their parent or guardian or with the permission of their parent or guardian.
  • Skippers. If you are the skipper, the licence details you add must be genuine and valid for the boat and the area. The charter company decides whether to accept them.
  • Visibility. Other App users linked to the same booking can see the passenger list, including the ID details on it. Only add people who are part of the booking.

Document scanning is optional. You can photograph an ID or passport so that the form is filled in automatically, or type the details yourself. Automatic reading can make mistakes, so check every field before you save. The passenger list you submit is passed to the charter company, which decides how to use it and whether to send it to the authorities.

You are responsible for the information you submit. Wrong or missing information can delay check-in or lead the charter company or authorities to refuse boarding; Sail Atlas is not responsible for those consequences.

7. Check-in, check-out and issue reports

The App lets you go through a pre-check or check-in checklist, add notes and photos, request check-out and report issues during the trip. These records are sent to the charter company and stored with your booking.

  • Be honest and accurate. Photos and notes you add can be used by the charter company as a record of the boat’s condition, for example in a discussion about the deposit or damage.
  • Whether check-in or check-out is complete, and any consequences for your deposit, are decided by the charter company under your charter contract.
  • The App is not an emergency service. In an emergency at sea or on land, contact the coast guard or local emergency services (for example 112 in the EU and Türkiye) and your skipper first. Messages and issue reports in the App may not be read immediately.

8. Orders, extras and APA

You may be able to order extras (for example equipment or services) and provisioning (food and supplies) through the App. These are requests to your charter company:

  • The charter company sets the prices, decides whether to accept an order and is responsible for delivering it.
  • Any contract for these extras or supplies is between you and the charter company, including your rights as a consumer, such as pre-contract information and any right of withdrawal.
  • Payment is arranged with the charter company.

9. Messaging and notifications

You can message your charter company in the App. Use messaging for your booking only. Be respectful and do not send spam, malware or unlawful content. Please do not share health or other sensitive information unless it is necessary. Your messages remain in the charter company’s records even after you delete your account. We do not read your messages, except where needed to investigate a report, protect security or comply with the law.

Notifications about your booking are sent through Apple and Google push services. Message notifications may show a short preview of the message on your device.

10. Boat guide, destination guide and other information

The boat guide, equipment and inventory lists, destination tips, restaurants, marinas, maps and routes are provided by the charter company or other sources for your convenience. They are general information and are not a substitute for the skipper’s instructions, official nautical charts, weather forecasts or safety briefings. Always follow your skipper, the charter company and the authorities.

11. Reviews and feedback

After your trip, you may rate the trip and the crew and leave comments. Your review goes to the charter company, and crew ratings may appear on the crew member’s profile. Reviews must reflect your genuine experience. Do not post insults, threats, discriminatory content, other people’s personal data or false statements of fact. We may remove reviews that are unlawful, abusive or fake, or that break these Terms. If the App suggests that you also leave a review on Google Maps, that review is subject to Google’s terms.

12. Acceptable use

You must not:

  • break the law or other people’s rights, including privacy and image rights;
  • give false information, use someone else’s booking without permission, or add people to a passenger list without authority;
  • harass or threaten the charter company, its crew or other guests, or post hateful, sexual or violent content;
  • upload malware, bypass our security or access controls, or try to access bookings that are not yours;
  • copy or collect data from the App in bulk, or reverse engineer the App except where the law allows;
  • interfere with the App or with other people’s use of it.

13. Your content and our App

“Your content” is what you add to the App, such as passenger details, photos, notes, issue reports, orders, messages and reviews. You keep ownership of it and confirm that you have the rights needed to add it.

You give Sail Atlas a non-exclusive, worldwide, royalty-free licence to host, store, copy, process, technically adapt (for example resize or automatically translate) and transmit your content only as needed to operate and provide the App, including passing it to your charter company and showing it to others linked to your booking. The licence ends when you remove the content or delete your account, except for content already shared with the charter company (which keeps it under its own retention rules), backup copies until they are deleted, and content we must keep by law. We do not sell your content or use it for advertising.

The App, its software and design, and the names and logos Sail Atlas, Atlas and Atlas Charter belong to us or our licensors. Content provided by your charter company belongs to it or its licensors. We give you a personal, non-exclusive, non-transferable and revocable licence to use the App for its intended purpose under these Terms.

14. Third-party services and links

The App works with services of other companies, such as Apple, Google and map providers, and may link to other websites, such as your charter company’s website or Google Maps. We do not control them; their own terms apply. Content from the charter company and other users is the responsibility of the party who provided it.

15. Availability and changes to the App

We cannot promise that the App will always be available or free of errors, especially at sea or with a weak connection; some content can be saved for offline use. We may change, add or remove features for valid reasons, such as security, legal requirements, technical changes or product improvement. If a change materially and negatively affects you, we will tell you at least 30 days in advance where reasonably possible, and you can delete your account at no cost. Your charter company decides which features it offers to its guests.

16. Ending your use

By you. You can stop at any time. You can delete your account in the App (Profile → Delete account) or as described on the Delete your account page. Your account data is deleted or anonymised within 30 days. Booking data, the passenger list and your messages remain with the charter company under its own retention rules; ask the company directly to delete them.

By us. We may suspend or close your account or limit your access if you break these Terms or the law, if your use puts others or us at risk, or if a law or authority requires it. Where reasonable, we will tell you in advance, give our reasons and let you respond. In serious cases we may act at once and tell you afterwards. Your access to a booking also ends if the charter company removes you from it or stops using Sail Atlas.

Sections 13, 17, 18 and 21 survive the end of these Terms.

17. Disclaimers and liability

To the extent the law allows, the App is provided “as is”. We do not guarantee that information from your charter company is accurate or complete, or that the charter company will perform its services.

Nothing in these Terms excludes or limits our liability for intent or gross negligence, death or personal injury caused by our negligence, fraud, liability under mandatory product liability law, or any other liability that cannot be excluded by law, including your mandatory rights as a consumer. Subject to that, and to the extent the law allows:

  • we are not liable for the acts or omissions of the charter company, its crew or other guests, including the charter itself, cancellations, refunds or deposits;
  • we are not liable for indirect loss or lost profits;
  • because the App is free, our total liability for all other claims in any 12-month period is limited to USD 100 (or its equivalent).

If you are a consumer in the EU or the UK, we are responsible for foreseeable loss caused by our breach of these Terms or our failure to use reasonable care and skill.

18. Consumer rights, governing law and disputes

Consumers. If you use the App as a consumer, the mandatory consumer protections of your country of residence apply and nothing in these Terms limits them.

  • Türkiye: you may apply to the Consumer Arbitration Committees (Tüketici Hakem Heyetleri) within the monetary limits set each year, or to the Consumer Courts (Tüketici Mahkemeleri), under Law No. 6502 on Consumer Protection. Mediation may be required before court for some claims.
  • EU/EEA: you keep the protection of the mandatory law of your member state, including your right to a digital service that conforms to the contract.

Governing law. These Terms are governed by the laws of the State of New Jersey, USA, without regard to its conflict-of-law rules. If you are a consumer, this choice does not remove the protection of the mandatory law of your country of residence.

Courts. If you are a consumer, you may bring a claim in the courts of your place of residence, and we will bring claims against you only there. Other users agree to the state and federal courts in Bergen County, New Jersey, unless mandatory law provides otherwise.

There is no mandatory arbitration and no class-action waiver. Before going to court, please write to info@sailatlas.app; we aim to resolve complaints within 30 days. This does not limit your right to go to a court or authority. Disputes about your charter are resolved with the charter company under your charter contract.

19. Changes to these Terms

We will tell you about material changes in the App or by email at least 30 days before they take effect. Changes required by law or for security, or that only benefit you, may take effect sooner. If you do not agree, you can delete your account before the change takes effect. If you keep using the App after that date, the new Terms apply, unless the law requires your express consent, in which case we will ask for it.

20. Privacy

The Customer App Privacy Notice explains how personal data is processed in the App, including the role of your charter company. Handle other people’s data you see in the App, such as the passenger list, only for your trip.

21. General

  • These Terms are the whole agreement between you and us about the App. If a provision is invalid, the rest stays in force.
  • We may transfer this agreement in a merger or reorganisation if your rights are not reduced. You may not transfer your account.
  • These Terms are available in English and Turkish. If the versions differ, the Turkish version applies to users in Türkiye and the English version to everyone else.
  • If you downloaded the App from the Apple App Store or Google Play, these Terms are between you and Sail Atlas, not Apple or Google, which are not responsible for the App or its support. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.
