This consent is optional. You can sign up to and use the Customer App without giving it. You can withdraw it at any time, free of charge and without giving a reason.
1. What you agree to and who sends
With this consent you agree that the senders below may send you marketing messages:
- HeyAtlas.ai LLC (Sail Atlas, United States): new features in the Customer App, announcements, surveys and satisfaction research.
- The charter companies whose bookings you link to your Customer App account: boat and route suggestions, early booking and seasonal campaigns, discounts and special offers, extra services and event announcements.
Your consent is passed to a charter company when you link one of its bookings to your account, and recorded with that company separately for each channel below. Each charter company is a separate sender and controller for its own messages and is itself responsible for following the commercial messaging rules of its country (for example, registration in the Message Management System (İYS) for companies in Türkiye). You can withdraw your consent per company and per channel.
This consent also serves as the prior consent required by the commercial messaging rules of your country (for example the TCPA for text messages in the United States, the EU ePrivacy rules or Turkish Law No. 6563).
2. Channels
- Email: to the email address on your account or booking record,
- SMS and WhatsApp: to the phone number on your account or booking record (by charter companies only),
- App notification and in-app message: to the devices where the Customer App is installed.
Message and data rates may apply to SMS; message frequency varies by charter company.
3. Personal data processed
First and last name, email address, phone number, language, device notification token, your past bookings (limited to the charter company concerned), and how you interact with messages (delivery, opens and link clicks). This data is processed based on your consent (Article 6(1)(a) of the GDPR for users in the EEA and the UK; Article 5(1) of the KVKK for users in Türkiye), only to send messages and improve them.
Sending may use Amazon Web Services (email, Germany), Twilio (SMS and WhatsApp, United States), Expo (app notifications, United States) and, if the charter company chooses, Mailchimp or Gmail (United States). See the Customer App Privacy Notice for details.
4. Service messages are separate
Messages with no marketing purpose, such as account and password actions, booking confirmations and changes, check-in reminders, payment and document notices, crew selection results and messaging with the charter company, are sent regardless of this consent.
5. Withdrawing your consent
You can stop marketing messages at any time:
- with the unsubscribe link at the bottom of every email,
- with the opt-out instruction in SMS messages (for example by replying STOP),
- in the app settings,
- by contacting the charter company concerned,
- by writing to info@sailatlas.app,
- for messages from charter companies in Türkiye, through İYS (iys.org.tr or e-Devlet).
Your request is processed within 3 business days at the latest and sending stops. We also pass the opt-outs you send us to the charter companies concerned.
6. Keeping records of your consent
Records of your consent and opt-out, together with the version of the text, the date and time, the sender and the channel, are kept for 3 years after the consent ends.
Consent statement: “I agree to receive marketing messages containing offers, campaigns and news from Sail Atlas and from the charter companies whose bookings I link to my account, by email, SMS, WhatsApp and app notification.”
